Federal Hemp Ban Looms as North Carolina Considers Legalization

Effectively, this allowed dispensaries to sell high quantities of products that contained low concentrations of THC (such as numerous gummies). This produced the “high” of marijuana in a legal manner. The loophole may also allow legal THC vapes. 

On April 30th, 2026, the Watauga Democrat reported that this loophole could be closed within months. By November of 2026, a new federal ban could mean that hemp dispensaries in North Carolina will have to stop selling these kinds of products. This also means that dispensaries left with shelves filled with these products may need to dispose of them or face legal charges. Hemp growers across the state also face economic shutdowns, and this industry has boomed in the Tar Heel State since 2018. 

North Carolina could step in and create a new bill that would supersede the federal ban. Regulating this industry instead of banning it could help the state cash in on an unregulated market worth billions of dollars in annual sales.
