Federal Hemp Ban Looms as North Carolina Considers Legalization

North Carolina Hemp Dispensaries Could Be Rocked by Upcoming Federal Ban


For those who don’t know, a loophole in federal law (the Farm Bill) makes the sale of certain hemp products in North Carolina completely legal. The loophole allows dispensaries to sell products as long as they contain below a certain threshold of THC (the active ingredient in marijuana). Effectively, this allowed dispensaries to sell high quantities of products that contained low concentrations of THC (such as numerous gummies). This produced the “high” of marijuana in a legal manner. The loophole may also allow legal THC vapes. 


On April 30th, 2026, the Watauga Democrat reported that this loophole could be closed within months. By November of 2026, a new federal ban could mean that hemp dispensaries in North Carolina will have to stop selling these kinds of products. This also means that dispensaries left with shelves filled with these products may need to dispose of them or face legal charges. Hemp growers across the state also face economic shutdowns, and this industry has boomed in the Tar Heel State since 2018. 


North Carolina could step in and create a new bill that would supersede the federal ban. Regulating this industry instead of banning it could help the state cash in on an unregulated market worth billions of dollars in annual sales. Lawmakers who support this course of action argue that regulation could lead to better testing and overall safety. 


Lawmakers Push for Medical Marijuana in North Carolina


At the same time, certain lawmakers in North Carolina are also pushing for the legalization of medical marijuana. They are currently discussing the possibility of regulating marijuana for legitimate patients, especially after the federal government rescheduled cannabis to make it a “less serious” drug. Because North Carolina tends to follow the lead of the federal government when it comes to cannabis, many marijuana advocates are encouraged by the way these discussions are going.
