The Governor of North Carolina has indicated that he may crack down on hemp while simultaneously voicing support for legal marijuana for adults. Although these two messages might seem conflicting, the governor could potentially achieve both goals. Whether you enjoy legal hemp or cannabis, it may help to keep up-to-date on these recent policy changes. If you already face criminal charges for hemp or marijuana possession, consider speaking with an experienced North Carolina defense attorney

New Council Will Recommend Changes to North Carolina’s Marijuana Laws

Many cannabis enthusiasts in North Carolina will be happy to hear that the governor has formed a new council that will recommend changes to the state’s marijuana laws. The governor has specifically stated that, based on these recommendations, he might be willing to legalize recreational marijuana use among adults.

The “State Advisory Council on Cannabis” consists of 24 members and will provide its final recommendations by the end of 2026, which means that these new changes could still be far away. However, the first set of recommendations will come as early as March 2026. These recommendations could include changes to the state’s laws.

Council members include law enforcement representatives, lawmakers, and Cherokee Indians. The latter group created the state’s first dispensary last year despite North Carolina’s ban on the sale of marijuana. They were able to do this because they technically have the final say over what happens on their land. The inclusion of the Eastern Band of Cherokee Indians shows that the state might be planning to set up its own dispensaries, and perhaps with important lessons from the Cherokee.

Governor Stein Voices Concern Over Unregulated Hemp Products

As most cannabis enthusiasts in North Carolina are aware, there is a major loophole in the state’s cannabis laws. This loophole allows people to purchase hemp products that contain enough THC to cause intoxicating effects, such as gummies and other edibles. Although the deregulation of hemp was meant to benefit industrial applications of this product, many smoke and vape shops today clearly sell these products to people who want to experience the intoxicating effects.

Stein has referred to this industry as the “Wild West,” and MJBizDaily claims that he is about to set up a “marijuana task force” to crack down on the sale of hemp. It is unclear whether these efforts would target end users or sellers, but this could lead to criminal charges for various individuals.
